Telecom Takeover: Telecommunications and AI Deregulation Threatens Local Control of Cell Towers…and Health, Environment, Safety, Privacy and Security

The telecommunications industry is pushing its powerful political levers to remove any meaningful local governmental or pubic oversight in the placement of 5G, cell towers or AI systems. A set of three overreaching federal regulatory pathways are designed to supersede already constrained municipal authority. These pose threats to privacy, security, identity, public health, mental health, environmental health, planetary health, and democracy.

Using an army of proposals from the Federal Communications Commission (FCC), proposed federal legislation and Executive Orders, industry is pushing to deregulate telecommunications by reforming local permitting rules. These new proposals would remove what the FCC and industry consider outdated “regulatory barriers” to the acceleration of the next generation of innovative telecommunications technology using wireless and wireline infrastructure.  By deregulating telecom and AI rather than strengthening regulations this jeopardizes privacy, security, the environment, human health and the democratic process itself. Some call this a moral hazard and other representatives call it an illegal privatization of public lands.

This topic is heating up now with more news coverage.  Wireless Estimator published “Local governments warn FCC expansion of permitting authority could trigger litigation” on Dec 29, 2025. “Major organizations representing over 200 million Americans have formally urged the FCC to withdraw or substantially revise the proposal”, Environmental Health Sciences wrote in an EHS press release  January 15, 2026. Broadband Breakfast published “Dozens of Orgs Say No to FCC’s Fast-Tracking Wireless Infrastructure: The FCC may be constrained in how it can consider health-based objections.” Inside Towers wrote, “Pushback From Cities and Counties on FCC’s Wireless Deployment Streamlining Efforts” Jan 14, 2026.

Former FCC environmental attorney penned, “Whatever Industry Wants: How the FCC Is Steamrolling Locals in the Cell Tower Rollout . On Jan 2, 2026 she wrote, “As wireless technologies proliferate—with presumably even less scrutiny, oversight, and public input—the environmental and community impacts will only multiply…The consequences of these failures are visible nationwide: protected landscapes and historic viewsheds marred, wetlands filled, endangered species habitat destroyed, sacred sites desecrated, burial mounds disturbed, and fragile underwater environments degraded. Equally important, the voices of communities and citizens have been suppressed and ignored…With almost 30 bills introduced on accelerating broadband siting this session, Congress too is doing its part to “free” industry from local control and environmental laws.” In a 2023 ProPublica article Peter Elkind underscores that,  “The FCC Is Supposed to Protect the Environment. It Doesn’t.”

FCC Build America: Eliminating Barriers to Wireless and Wireline Deployments

The “Build America” agenda is part of FCC’s  “Delete, Delete, Delete” proceeding and the administrations executive order 14219 “to commence the deconstruction of the overbearing and burdensome administrative state.” The FCC clearly states their intent noting, “With this Notice of Proposed Rule Making (Notice), we advance the Commission’s Build America Agenda by proposing reforms that would free towers and other wireless infrastructure from regulatory burdens imposed at the state and local level.” (FCC 25-276) While these FCC proposals are stated for the purpose of removing barriers to nationwide wireless expansion, it will instead give all the power to industry and produce barriers to the safe deployment of cell towers by increasing administrative staff burdens, increasing costs, reducing municipal compensation, reducing public input, permanently dismissing health or environmental impacts, and creating a larger digital divide.

The FCC seeks comment “on every rule, regulation, or guidance document that the FCC should eliminate for the purposes of alleviating unnecessary regulatory burdens.” They state it is the next step in the “Administration’s decision to usher in prosperity through deregulation (Executive Order 14192). This is not only for the unobstructed deployment of wireless antennas and cell towers to develop autonomous telecommunications networks with generative AI, but also includes removing “obsolete technology”, i.e. copper landlines which are critical in rural areas and in emergencies (CPUC 2024). An FCC comment notes, “This initiative is not about “building America” — it is about stripping away local rights, eliminating public participation, and giving the wireless industry near-total control over the placement of cell towers.”

The 2018 Small Cell Order Ruling is Intensified

This request for comments, along with FCC Docket 25-253 (for wireline deployment) aim to amplify the 2018 FCC  Small Cell Order Ruling, “Accelerating Wireless and Wireline Broadband Deployment by Removing Barriers to Infrastructure Investment” (FCC 18–111 and FCC 18–133) by further preempting and obliterating local authority.

The League of Mayors, among others, were opposed to the original 2018 FCC Small Cell Order stating, “The Commission has embarked on an unprecedented federal intrusion into local (and state) government property rights that will have substantial and continuing adverse impacts on cities and their taxpayers, including reduced funding for essential local government services, and needlessly introduce increased risk of right-of-way and other public safety hazards.” They noted the FCC seeks “to use a misapplication of federal power to confiscate local taxpayer property.” The League of Mayors underscores that this is in effect federalizing local public property “as part of its efforts to bestow upon a class of private companies special rights to access local rights-of-ways and public property.” 

The late Senator Diane Feinstein and former Representative Anna Eshoo strongly opposed the 2018 Small Cell Order, understanding both the significant burdens to municipalities in addition to the loss of democratic processes. Both Feinstein and Eshoo introduced bills in Congress asking that the 2018 Small Cell Order “be null and void.”  (Feinstein SB 2012 Restoring Local Control Over Public Infrastructure Act of 2019 (Eshoo HR 530 ; Accelerating Broadband Development by Empowering Local Communities Act).

More Power to an Already Powerful Telecom Industry

These actions give away more power to industry, and remove it from municipalities and ordinary citizens. Counties, cities, mayors and telecommunication officers have expressed their dismay and concerns over these rulings in  letters to the FCC. In one letter they note the FCC proposals will, “strip local governments of their ability to responsibly manage public assets in the rights-of-way”, leading to public safety issues. Millions of miles of public and private utility networks and infrastructure exist above ground but also underground and require thoughtful coordination to prevent accidents such as water leaks, sewage leaks,  gas leaks and explosions.  

A 2022 report “Feeling the Squeeze: The Harmful Effects of Small Cell Preemption on Local Governments”  found the original 2018 Small Cell Order preemption had a negative impact on cities’ finances, created challenges for public safety and interfered with efforts to close the digital divide. It also created more legal attacks on cities which further burden already strained budgets.

  • 52% percent of cities reported that companies have damaged public property at least once.
  • 57% percent of localities report that providers have failed to restore roads, sidewalks, or other infrastructure to its original condition following installation at least once.
  • 40% of localities report that installations have created accessibility issues at least once.
  • 33%  reported that they have had installations that endanger the public.
  • 57% of large localities, have dealt with contractors lacking the proper licenses.

The report concludes, The National Association of Telecommunications Officers and Advisors (NATOA)recommends the FCC abandon the approach of the 2018 Small Cell Order; restore the authority of local governments to protect community health and safety; abandon ill-conceived fee caps; and shift the burden of proof back to the provider in disputes.”

What Will FCC and Supporting Legislative Cell Tower Deregulation Do?

Comments by counties, cities, mayors, non-profits such as FACTS, EHS, EHTrust, PST and others note these “streamlining” proposals to remove “burdens” to the telecom industry will secure laws that allow cell towers with tag along batteries and complex electrical equipment anywhere – “near homes, schools, parks, hospitals, environmentally sensitive areas, as well as fire prone areas with no recourse.” Some call this the new industrialization of cities and would be done by:

  • Eliminating vital community protections by preempting local ordinances and local zoning laws
  • Placing “deemed granted” shot clock limits mandating time stamped automatic approval of wireless facilities
  • Allowing only industry certification of radiofrequency radiation while prohibiting local governments from requiring independent, third-party verification of FCC radiofrequency emissions compliance
  • Eliminating consideration of critical local factors such as aesthetics, property values, historic preservation, and cumulative neighborhood impacts.
  • Undermining property rights by permitting infrastructure that can reduce home values without recourse or compensation.
  • Removing all environmental considerations such as NEPA
  • Preventing safety considerations for wildfire
  • Silencing residents by eliminating public hearings
  • Silencing local governments by removing conditional or special use permits for even large monopole cell towers
  • Removing states abilities to regulate AI intrusions
  • Removing local and state democratic decision-making processes our country is founded on

Brave New World of Tech: Adding AI to the Mix

The telecommunications industry is comingling personal wireless services with other internet commercial services and evolving into a business that is less about communicating and more about transforming the “network” to enable data collection, surveillance and artificial intelligence (AI), in order to transform “the way we live and work”. Industry admits this is necessary to “unlock opportunities” for industry profit, although it is marketed for our benefit.  

And it does sound good. Optimizing network performance, enhancing efficiency, and fully transforming our telecom connected world into a seamlessly AI generated system. No protective regulation has been proposed, unlike in Europe with the 2024 EU AI Act. This lack of regulation could lead to host of problematic issues including unethical monitoring of individuals, unsafe robotic machines and autonomous hackable transportation in a brave new world where every footstep is tracked, saved on servers and sold to third parties. The article in Forbes states, “With the help of 5G, the hope is to one day use that information to control entire fleets of unmanned ships from the shore.”

Have we finally opened the door for man to step willingly into the Matrix, interconnected by a dense network of 5G towers along with black box AI generated content for humans to consume? Perhaps, however, some thought needs to be given to the downsides of our hyperconnected world as well as the effects of fast tracking technology on the natural environment, and consider adopting our own comprehensive regulation before accelerated telecommunications expansion with AI quickly becomes an unwelcome reality.  

The American Communication Association (ACA) in its comments advised the FCC to reaffirm “that Section 253 applies to facilities where telecommunications services are commingled with other services”, and “infrastructure that may be used to provide telecommunications services.”  The Wireless Infrastructure Association (WIA) added in their comments, “Broadband will be foundational to both the training and deployment of AI systems, enabling the fast transmission of vast amounts of data among and between consumers, researchers, and industry.”

23 States Commented to the FCC that It Lacks Authority on AI

23 states (Arizona, California, Colorado, Connecticut, Delaware, District of Columbia, Hawaii, Ilinois, Maine, Maryland, Massachusetts, Minnesota, Nevada, New Jersey, New Mexico, North Carolina, Oregon, Rhode Island, Tennessee, Utah, Vermont, Washington and Wisconsin) wrote a letter to the FCC opposing  “preemption of state and local laws governing the impact of Artificial Intelligence (“AI”)-enabled technologies on their citizens and, more broadly, to demonstrate that the Commission should not issue any declaratory ruling purporting to pre-empt state (and local) laws “seeking to govern or limit uses of AI…AI as a set of machine-enabled activities is beyond the jurisdiction of the Commission… AI is not the “transmission, between or among points specified by the user, of information of the user’s choosing, without change in the form or content of the information as sent and received…Instead, AI is a classic information service. The Commission’s reference to “wireline telecommunications” does not provide authority to oversee state (and local) regulation of AI.” https://www.fcc.gov/ecfs/document/1217194355542/1

America’s AI Action Plan – “Build, Baby, Build!

In  Winning the Race America’s AI Action Plan July 2025 the White House states, “it is a national security imperative for the United States to achieve and maintain unquestioned and unchallenged global technological dominance [in AI]… We need to build and maintain vast AI infrastructure and the energy to power it. To do that, we will continue to reject radical climate dogma and bureaucratic red tape, as the Administration has done since Inauguration Day. Simply put, we need to “Build, Baby, Build!”. The plan is to “Create Streamlined Permitting for Data Centers, Semiconductor Manufacturing Facilities, and Energy Infrastructure”

White House Recommended Policy Actions: Deconstruction

  • Establish new Categorical Exclusions under NEPA to cover data center-related actions
  • Expand the use of the FAST-41 process to cover all data center and data center energy projects eligible under the Fixing America’s Surface Transportation Act of 2015.25
  • Explore the need for a nationwide Clean Water Act Section 404 permit for data centers, and, if adopted, ensure that this permit does not require a Pre-Construction Notification
  • Expedite environmental permitting by streamlining or reducing regulations promulgated under the Clean Air Act, the Clean Water Act, the Comprehensive Environmental Response, Compensation, and Liability Act, and other relevant related laws
  • Make Federal lands available for data center construction and the construction of power generation infrastructure for those data centers by directing agencies with significant land portfolios to identify sites suited to large-scale development.

The European Union AI Act of 2024: Human Centric and Trustworthy AI

The European Union AI Act is markedly different than the U.S. version and puts the EU in a leadership position in AI development and governance. The EU AI Act is the first comprehensive legal framework for AI regulation in the world and aimed at protection and safety. It was first published July 12, 2024 and will be effective August 2, 2026.

The Act promotes AI but with a “Code of Practice” and obligations that relate to transparency, safety, security, and intellectual property protections.  “The EU AI Act is intended to promote the uptake of human-centric and trustworthy AI and to ensure a high level of protection of health, safety, fundamental rights, democracy, and rule of law from harmful effects of AI systems while supporting innovation and the functioning of the internal market.” The EU AI Act also applies to providers and deployers outside of the EU if their AI products are used in the EU. There are significant penalties for noncompliance.

The EU AI Act uses a risk management framework, classifing AI systems into Unacceptable Risk, High Risk, Limited Risk and Low or Minimal Risk:

Unacceptable Risks are prohibited and include social scoring systems, emotion recognition systems, untargeted scraping of facial images for facial recognition databases, certain biometric identification systems, specific predictive policing applications and developing or using an AI system that intentionally manipulates people into making harmful choices.

High Risk include certain medical devices, certain education and vocational training contexts, in the judicial and democratic process such as systems that are intended to influence the outcome of elections, to determine access to essential private or public services, in critical infrastructure management (for example, water, gas and electricity supplies), in any biometric identification system which are not prohibited,

Related EU Laws Affecting AI are:

The EU General Data Protection Regulation (EU) 2016 to protect personal data and ensure consistent data protection standards across the EU.

The Product Liability Directive 2024 expands protections for consumers by allowing compensation in claims of damage related to new technologies. 

The General Product Safety Regulation 2023/ updates consumer protections “Ensuring better product safety is vital to protecting consumers and providing safe products.” And includes “new technologies and concerns, such as cybersecurity and digital connectivity.”

Retained EU Law for Intellectual Property includes multiple harmonized laws to protect property rights including artists.

Manufacturing a Need for Tech?

Although industry paints these deregulatory efforts as solving increasing consumer demand, the demand is largely manufactured by industry that is pushing this narrative of need and narrowing choices for the public. The convenience of tech is addictive. Everything is at our fingertips so we do not have to critically think anymore. The threats to this careless expansion of technology includes privacy, security, identity, public health, mental health, environmental health, planetary health, and democracy with the loss of public input.  

In a 2020 report,  5G: State of Play in Europe, USA and Asia. In Depth Analysis, the expert authors indicated many years ago that 5G is a manufactured need stating, “As 5G is driven by the telecoms supply industry, and its long tail of component manufacturers, a major campaign is under way to convince governments that the economy and jobs will be strongly stimulated by 5G deployment. However, we are yet to see significant “demand-pull” that could assure sales…The notion of a “race” is part of the campaign but it is becoming clear that the technology will take much longer than earlier generations to perfect.”

Telecommunications Battle Continues in the Legislature

As the FCC proposals move forward, parallel proposed legislation hopes to set the identical FCC proposals firmly into law. Those who are concerned about this issue are encouraged to write to their representatives in the House and if these bills do pass then alert their senators about  HR 278,HR 1343, HR 1588, HR 1665, HR 1681, HR 1731, HR 1836 HR 2289, HR 5264 and HR 6046.

Physicians for Safe Technology Policy Recommendations

We strongly oppose the elimination of setbacks, coverage and aesthetics as criteria for consideration by local governments when considering permits for proposed cell towers, both macro and small cell. We also oppose the shortening of shot clocks which tie the hands of local government to safely deploy both wired and wireless telecommunications. The evidence points to broad risks to human health, the natural world, privacy, security and safety with deregulation of telecommunications and AI. Laws need to be strengthened not weakened for basic protection of the environment, human rights and the democratic process.

We recommend:

1. That instead of expanding the 2018 Small Cell Order in these overreaching FCC proposals, the 2018 Order should be reversed and considered “null and void” to restore local authority, public input, appropriate health and environmental considerations and public confidence in government.

2. That prior to further deregulation of wireless expansion that the FCC or Congress set up an independent commission or agency to comply with the 2021 Court Order EHT vs FCC and complete its reevaluation of the current safety standards for wireless radiation. This reevaluation needs to use updated science to set heath and environmentally protective limits on the biological effects of non-ionizing wireless radiation, and not just use the obsolete heat effect standards. It should take into consideration health impacts, the environment, children’s vulnerability, long term effects, power reduction, energy reduction and the risks of new and emerging technologies

3. That Section 704 of the 1996 Telecommunications Act be amended to allow health and environmental effects to be factors in the placement of cell towers to rationally protect public health and the environment. Section 704 FACILITIES SITING; RADIO FREQUENCY EMISSION STANDARDS of the 1996 Telecommunications Act. (iv) No State or local government or instrumentality thereof may regulate the placement, construction, and modification of personal wireless service facilities on the construction, and modification of personal wireless service facilities on the basis of the basis of the environmental effects of radio frequency emissions to the extent that such facilities comply with the Commission’s regulations concerning such emissions.

4    That landlines be protected, especially in rural areas requiring telecommunications to maintain their equipment in working order as a primary means of communication for some and a backup for others.

5. That the National Environmental Policy Act and the Migratory Bird Treaty Act in the U.S.be strengthened for greater protection in the face of this onslaught of new technologies which use more RFR spectrum on land and in space.

6. To define air as habitat to enable protection of species using it and create EMF-free zones during migration and breeding seasons where possible.

7)   Allow states to regulate AI for public safety, accountability, transparency, cybersecurity, personal security, privacy and environmental harms using the European Union AI Act as a model for comprehensive legislation.

Thousands of Letters Sent to FCC to Oppose these Proposals

Over 2,000 letters have been written by government representatives, nonprofit organizations and citizens to oppose these proposals. They highlight the many issues faced if these proposals pass.

29 Cities and Municipalities wrote to the FCC with an introduction stating,The Commission’s NPRM begins with a significant omission: it completely ignores that the legal rug has been pulled out from beneath its existing guidance and rules governing preemption of local authority on wireless siting. The law underlying the Commission’s wireless siting rulings are now in question… The local, democratically accountable, zoning framework ensures that wireless infrastructure is deployed efficiently while maintaining public safety and the unique aesthetic character cherished by each community…Local government authority over land use is critical to protect the health and welfare of local communities and private property values.”
